Terms and Conditions of Use – Fonte SMM

Preamble and Membership Agreement

This document constitutes a Legal Agreement and Membership Contract entered into by and between Fonte SMM (hereinafter referred to as the "Platform" or "Contractor") and the individual or legal entity that registers and adds funds on the domain fontesmm.com (hereinafter referred to as the "User" or "Client").

By creating an account, integrating via API, or depositing funds on Fonte SMM, the User declares that they have read, understood, and expressly, unconditionally, and irrevocably agreed to all clauses set forth herein. If you do not agree with any provision, you must immediately cease using the Platform.

Clause 1: Definitions and Interpretations

For the proper interpretation of this commercial and legal contract, the following terms are defined as:

• Digital Services: Delivery of quantitative metrics (followers, likes, views, etc.) allocated through server infrastructure.
• Balance/Credits: Currency value converted into internal, non-refundable points for exclusive consumption within the Platform.
• Target Social Network: Third-party platforms (such as Instagram, TikTok, YouTube, X, etc.) where the digital services will be reflected.
• API (Application Programming Interface): A set of programming routines that allow the User to connect their own system or website to Fonte SMM servers in an automated manner.

Clause 2: B2B Nature and Inapplicability of Consumer Protection Laws

• Fonte SMM is a wholesale traffic brokerage platform developed strictly and exclusively for marketing professionals, agencies, and resellers operating under a Business-to-Business (B2B) model.
• The User certifies that they purchase the services as an input for their own production chain and economic activity, and do not act as a final consumer.
• It is expressly agreed that local consumer protection laws and statutory right of withdrawal rules do not apply to this contract. The material and procedural relationship shall be governed exclusively by Civil and Commercial Law.

Clause 3: Exclusion of Liability for Third-Party Acts and Force Majeure

• Operational Independence: Fonte SMM has no administrative affiliation, partnership, or endorsement from the Target Social Networks.
• Inherent Risk: The User is aware that social networks conduct regular audits, security sweeps, and algorithmic updates. Drops in metrics, account suspensions, temporary restrictions (shadowban), or blocks occurring on the target account are considered "Third-Party Acts," exempting Fonte SMM from any objective or subjective liability.
• Fonte SMM’s contractual obligation is configured as an Obligation of Means/Immediate Delivery, rather than lifetime maintenance. Effective delivery concludes the Platform's responsibility, except for services offering an explicit refill guarantee.

Clause 4: API and Automated Integration Conditions

For Users who integrate their own resale panels with Fonte SMM servers via API:

• The User is entirely responsible for protecting their API Key. Fonte SMM will not refund orders generated by leaked credentials, code errors on the User's website, or logical flaws on the reseller's platform.
• The User undertakes to respect rate limits. Attempts at denial-of-service attacks (DDoS), reverse engineering, or intentional overloading will result in the summary ban of the IP address and loss of funds.
• Fonte SMM holds no responsibility toward the User's end clients. All end-user support must be provided exclusively by the reseller.

Clause 5: System Availability and Infrastructure (SLA)

• The Platform will use its best efforts to keep servers online uninterruptedly; however, relying on virtual network infrastructure (VPS/Servers), it does not guarantee 100% stability or uptime.
• Outages for preventive maintenance, database updates, or panel instabilities do not constitute a breach of contract or generate the right to compensation for lost profits to the User.

Clause 6: Financial Policies, Pricing, and Anti-Fraud

• Irreversibility of Deposits: Upon adding funds, the amount becomes usable exclusively within the Platform. No cash withdrawals, bank transfers, or refunds in cash are processed.
• Price Fluctuation: Service costs are volatile and based on global server supply and demand. Fonte SMM reserves the right to change rates without prior notice. The charged amount will always be the one effective at the moment of clicking the "Buy" button, not at the moment of the balance deposit.
• Cybercrime and Chargebacks: The malicious opening of payment disputes or chargebacks with gateways or credit card issuers aiming for unjust enrichment constitutes financial fraud. Upon confirmation of the act, Fonte SMM will take immediate measures: Irreversible account and IP ban; Confiscation of remaining balances; Technical reversal of metrics delivered to the target profile; Forwarding of the Digital Dossier (Logs, IPs, Documents) to law enforcement authorities and credit protection bureaus.

Clause 7: Service Provision, Warranties, and Loss of Rights

• Order Immutability: Once an order status is marked as "Pending," "Processing," or "In Progress," it is strictly impossible to cancel, interrupt, or edit the service order.
• Service Categories:
  No Refill: Full risk assumed by the User. Drops do not entitle the User to refills, replacements, or partial refunds.
  Refill: Covers drops exclusively within the specified timeframe (e.g., 30 days) and must be manually requested via the panel.
• Immediate Extermination of Warranty: The User loses the right to any refund or refill if they: Make the target account Private/Restricted; Change the username (@) or target publication link; Place duplicate, simultaneous, or competing orders for the same link (whether on Fonte SMM or external panels).

Clause 8: Legal, Tax, and Prohibited Uses

• The User acts as an independent business entity, assuming total responsibility for tax, labor, consumer, and fiscal obligations inherent to their resale operation toward their own audience.
• It is strictly prohibited to use the Platform for: Partisan political propaganda, public opinion manipulation, or electoral fraud; Boosting criminal content, child exploitation, terrorism, hate speech, or Intellectual Property violations; Deceiving or causing financial harm to third parties.

Clause 9: Deadlines and Credit Validity

• Balances originating from conventional transactions expire after 6 (six) months of inactivity.
• Balances originating from promotional campaigns and bonuses expire after 3 (three) months.
• Expired credits are automatically removed from the database and cannot be revalidated.

Clause 10: Absolute Limitation of Civil Liability

If Fonte SMM is held judicially or extrajudicially liable for any damage provenly caused to the User, it is agreed that the maximum compensation shall not exceed, under any circumstances, the total amount of credits acquired and consumed by the User in the 3 (three) months prior to the triggering event of the controversy.

Clause 11: Data Privacy

• Fonte SMM adopts privacy principles. We collect contact information, connection logs (IPs, geolocation), and transaction records based on legitimate interest and contract execution legal grounds.
• The User consents to receive notifications, marketing actions, system alerts, and billing notices via Email, SMS, WhatsApp, and Telegram provided during registration.
• At any time, the User may request the deletion of their data, acknowledging that account termination will result in the irrecoverable loss of financial history and acquired rights.

Clause 12: Applicable Law and Forum

This Agreement is governed by the laws of the operating jurisdiction. For the resolution of all demands arising from or related to this contract that fail to succeed through direct negotiation with Technical Support, the parties exclusively elect the jurisdiction of the Platform's administrative headquarters, waiving any other, no matter how privileged it may be or become.
